Arrival Times

You must be ready to take part in your booked activity at the designated 'start-time' to enable a full safety briefing to take place.  You should arrive 10-15 minutes early to allow time to get ready for the activity.  The time stated on your confirmation is the start time not arrival time.

The booking will normally be treated as a cancellation in the event of late arrival with the loss of all monies and you will be turned away.  Please take arrival times seriously allowowing for any possible delays on route to the venue.

Health & Safety

It is your responsibility when booking to ensure that you and members of your group are fit enough to cope with the activity.  Participants must inform Och Aye Canoe prior to the event of any medical condition / illness / disability (including medication which may affect their performance) so we can discuss your needs and make appropriate arrangements.  All participants should inform their instructor immediately if they feel unwell during the activity.   Failure to complete the booking form in full prior to the activity booked may result in participants being excluded from activity without refund.

Exclusion From Session

Och Aye Canoe has the right, at all times, to refuse participants access to the booked activity at any stage of their booking and remove them from their session if in their opinion participants are unfit to take part in the activity because of physical or mental impairment; be under the influence of alcohol or drugs; have arrived too late to take part in the pre-sessions safety briefing; consider them to be a danger to themselves, other participants or members of staff; or are displaying aggressive and abusive behaviour (verbal or physical). If any of these occurrences apply, the booking will have been deemed to have been cancelled and cancellation charges will apply.  There are no exceptions.

Activity Risk

Och Aye Canoe is dedicated to providing safe and enjoyable activities and skills training, however the nature of the activities and the locations used means that a risk of personal injury or even death may be present, despite all efforts made to reduce the risks.  All participants are reminded that a real element or risk may always be present.

Participants in activities and parents or legal guardians should be aware of and accept these risks as part of the course and be responsible for their own involvement.

Under 18's must have a parent or legal guardian present and contactable at all times whilst the activity is on-going.

Not fully disclosing any medical information may lead to dangerous occurrences or even death, the participant accepts this.

Participants agree to follow the advice and direction of instructors at all times.  Participants understand that failing to do so may result in injury or death, neither of which Och Aye Canoe is responsible for.

 

Trademarks & Brand Name

Och Aye Canoe is a registered trademark.  No one may use our names, trademarks, domain names or logos for any purpose without our express written permission.  Any unlawful use of our brand will be dealt with by law.

 

Conditions of Hire of Equipment

Introduction

Stand Up Paddleboards (SUP’s) and / or kayaks and other associated equipment can only be hired upon completion of a booking form along with an agreed payment and security deposit. The signatory of the booking is the designated hirer, confirming that he or she has the authority to make such a booking on behalf of other persons. Upon acceptance by us of your completed booking form a binding contract is formed between you and us on the terms and conditions set below. We reserve the right not to accept or fulfil a booking. All bookings are subject to availability.

The hire period commences from the time you are in possession of the equipment and continues until the equipment is returned to us.

 

Your responsibilities

You are responsible for ensuring you are physically fit enough to stand up paddle board and / or kayak. Any  medication you do need make sure you have it with you on the water. All users must be competent and confident in their abilities to navigate a SUP / kayak and able to swim 25 meters unaided. We do not accept liability for changes in your period of hire due to weather and other causes out of our hands. You accept responsibility to indemnify us against any claim, interest, demand or expense in respect of such injury or damage.

You are responsible for all SUP’s / kayaks and equipment hire, keeping it safe from damages, loss or theft. Use it respectfully and not cause unfair wear and tear.

You will notify us immediately of any loss, damage or theft to the hired SUP’s / kayaks and equipment and will be responsible for paying us reasonably costs of reparation of any such loss, damage or theft. 

You will not offer for sale, sell, dispose, mortgage, lend or pledge or otherwise part with the hired stand up paddle boards / kayaks and equipment.

You understand that you are participating in stand up paddle boarding / kayaking at your own risk.

Buoyancy aids are to be worn at all times on and around the water. You must provide your own suitable clothing to wear during the time of hire.

You will paddle the SUP / kayak responsibly at all times. Hire will be revoked during your hire period in cases of reckless behaviour, putting others lives at risk, with no refund will be given.

Clients who booked by telephone will be deemed to have read and accept these terms and conditions.

You have the right to terminate this agreement at any time leading up to the time of hire, however unless we agree otherwise you will not be entitled to a refund.

Hire on the day is subject to safe weather conditions. If a postponement of your hire is deemed necessary by Och Aye Canoe Ltd staff we will give you as much notice as possible and we will offer you alternative dates, if no convenient alternative date can be agreed, any monies paid will be fully refunded.  

You agree to only use the SUP’s kayaks and equipment in the manner described by Och Aye Canoe Ltd and to use them on site only.   

 

Personal safety

Each participant is responsible for their own safety. You must not be under the influence of drugs or alcohol when using the paddle boards / kayaks. Hire will be revoked during your hire period if you become intoxicated, with no refund given.

Young persons under the age of 18 must be accompanied by an adult while on or near the water.

Stand Up Paddleboards / kayaks must not be used during hours of darkness. Any equipment including paddleboards / kayaks must not be left unattended at any time. 

You must be respectful of other water users in crafts such as kayaks, paddleboards, swimmers and fishermen.


Payment and deposit

Payment for the whole hire period is required before hire commences along with the completed booking form. Proof of identity may be required in the form of a valid driving licence or passport.

 

If the terms stated above are not complied with, we reserve the right to charge reasonable charges until the paddleboards/equipment are returned to us. If paddle boards/equipment are returned damaged you are responsible for the costs incurred and sustained in replacing or repairing the items concerned to a condition equivalent to that before hire commenced. In all cases normal wear and tear as defined by the products manufacturer or supplier is accepted and allowed and is included in the hire price.

 

Our liabilities to you

We will not be liable to you where any alleged loss or damage results from:

  • any of your own actions or omissions
  • the action or commission of a third party not connected with the provision of your paddle board / kayak hire.
  • an event or circumstances which we could not have predicted or avoided even after taking all reasonable care.
  • where any loss or damage is considered to be indirect or consequential loss.

Except in respect of death and personal injury, in respect of which no limit of liability shall apply, our total liability to you under this contract between us shall be limited to the total cost of your booking.

We shall have no liability to you if we are unable to fulfil a booking due to an event of force majeure. In the event of us being unable to fulfil your booking, our liability to you shall not exceed the agreed cost of the hire.

INSURANCE Och Aye Canoe Ltd confirms that it is covered by public and liability insurance; however we offer no insurance cover regarding personal accidents to individuals that may occur during the term of this hire agreement. In your own interest paddle boarding / kayaking involves an element of risk; you are strongly advised to take out insurance cover against accident, emergency rescue, and personal injury, loss of luggage, equipment damage and cancellation.

These terms and conditions constitute the entire agreement between you and us.
